A Denver sheriff’s deputy narrowly avoided being fired for crashing a car into a highway barrier while his blood alcohol content was nearly four times the legal limit.

Deputy Jonathan Velez will serve a 10-day suspension for the crime, which occurred while he was off-duty and driving his personal vehicle. But if he has a similar disciplinary issue in the next two years he will be fired, according to a Denver Department of Public Safety disciplinary letter obtained by The Denver Post through a public records request.

On March 10, Velez drank at least six shooters of vodka and six beers before getting in his car with his 16-year-old son and driving on Interstate 70, according to the letter. Velez crashed the car into a wall on the ramp between westbound I-70 and Interstate 225.

No other cars were involved and Velez’s son was not injured, but Velez was transported to the hospital with injuries. His BAC was .319 at the time of the crash and he was contacted by Aurora police officers at the hospital, according to the letter.

Velez, who has worked for the department since 2006, told Denver Sheriff Department officials that the decision was the worst mistake of his life and said he was remorseful and embarrassed. He said he was seeking treatment for alcohol use. As part of the discipline, Velez must attend counseling.

“Deputy Velez has accepted responsibility for his misconduct, acknowledged his wrongdoing and has participated (and continues to participate) in extensive treatment, counseling and support groups to address issues related to his violation,” the letter states.

Velez pleaded guilty Oct. 15 to a misdemeanor charge of driving under the influence and was sentenced to 18 months of probation.
