Sentencing in the criminal case involving a former Florence-Penrose School District bus driver who allegedly slapped a student last spring has been completed, but a judge has sealed all of the information, including the outcome.

Bertram Arman Jaquez, 63, was arrested May 19, after he was accused of slapping a child for not wearing a mask properly. Video of the altercation has circulated via various social media platforms since the event.

Jaquez originally was facing charges of child abuse causing injury, third-degree assault and harassment.

The incident reportedly happened in April and the school district immediately began an investigation and eventually fired Jaquez after first placing him on administrative leave, Superintendent Dr. Brenda Krage said.

A senior judge in June sealed most court documents and issued a gag order in the case. Jaquez’s attorney, David Brown, filed a motion May 25 to limit pretrial publicity and a motion June 1 to limit public access. He said the motions should be granted because of his client’s right to a fair trial, as well as his client’s safety.

“We ask on those grounds alone that this motion be granted,” Brown said during the June 29 hearing. “There have been several threats made to my client via phone message, even a text message to his wife.”

Senior Judge Stephen Sletta entered an order in June sealing all records in this case with the exception of the arrest affidavit. He also issued a gag order barring attorneys associated with the case, as well court personnel and law enforcement officers from discussing the case in public.

The Daily Record learned Friday of Jaquez’s sentencing that took place Thursday.

District Attorney Linda Stanley said the case will remain sealed per the judge’s order.

“We did not have any objection because we wanted to protect the child, as well (as did her parents),” Stanley said.

Stanley said she handled this case personally and was in constant contact with the family.

“I handled the case the way they wanted it to be handled and did what they asked me to do on the case despite the fact that I wanted to take it to a trial,” she said.
